PRODUCT TERMS FOR LAND RENTAL

1.LAND AND ITS OFFER

1.1.The Provider offers Land on the Portal by electronic means by filling in the Land information in the relevant form within their User Account and submitting this information to the Operator by clicking the "Offer" button. Land information includes uploading photographs of the Land, whereby by making an offer of the Land, the Provider expressly authorizes the Operator to use the photographs for the purposes of the services provided by them, for the entire duration of the User Account Agreement.
1.2.In the event that the Provider offers only part of the Land for temporary use (i.e. typically in cases where the capacity of Interested Parties is greater than one), the Provider shall specify the individual parts of the Land in the Land offer (e.g. by means of an orientation map); this does not apply in cases where the Land is offered in Mode C pursuant to Article 2.5 of these Product Terms. For the avoidance of doubt, however, the Provider is also responsible in this case for the proper performance of all Rental Agreements concluded in relation to this Land.
1.3.In the event of any change in the Land information provided by the Provider in the Land offer form (Article 1.1), the Provider is obliged to update the Land information without delay. Breach of this obligation shall be deemed to be a material breach of the Provider's obligations.
1.4.The Provider is only entitled to offer Land for temporary use for payment on the Portal that is suitable to be the subject of a Land Rental Agreement and for which there are no obstacles to the Interested Party's use for the agreed purpose (camping). In this context, the Provider declares in particular that:
1.4.1.The Land is owned by them or they have another right of use to the Land (e.g. a rental agreement, etc.);
1.4.2.the provision of the Land for temporary use for payment is not prevented by any legal or other regulations, nor by any contractual or other agreement with a third party or any right of a third party;
1.4.3.The Land is suitable for camping, and camping on the Land does not present an increased risk of personal injury or damage, particularly due to the poor condition of the Land or adjacent properties;
1.4.4.camping on the Land is not prevented by any legal or other regulations, nor by any contractual or other agreement with a third party or any right of a third party;
1.4.5.The Land is suitable to be the subject of a rental agreement; and
1.4.6.The Provider has all public law authorizations necessary for renting out Lands.
1.5.If any of the above declarations by the Provider prove to be false, this constitutes a gross breach of the Provider's obligations under the User Account Agreement.
1.6.The Provider is solely responsible for the selection of the Land to be offered on the Portal. This does not affect the Operator's rights pursuant to Articles 1.7 and 1.8 of these Product Terms.
1.7.The Operator is not obliged to accept the Land offer for publication on the Portal. The Operator reserves the right to make a final decision on which Land will be published on the Portal and not to publish the Land on the Portal, in cases specified in Article 4.5 of the Terms and Conditions.
1.8.The Operator reserves the right to remove any Land offer from the Portal in cases specified in Article 4.5 of the Terms and Conditions.

2.OFFER MODES

2.1.When entering a Land offer pursuant to Article 1.1, the Land is automatically offered in the Exclusive Partnership mode pursuant to Article 2.3 of these Product Terms. The Provider may subsequently manually request the Operator to change the offer mode in accordance with this Article 2 of these Product Terms.
2.2.The Provider may request a change of the mode selected when entering the Land offer within their User Account, once every 3 months. In such case, the change of mode becomes effective 14 days from the date of submission of the request by the Provider. The selected mode can also be changed based on an individual agreement between the Provider and the Operator.

2.3.Exclusive Partnership (Mode A)

2.3.1.In this mode, the Provider may not offer the Land for rent and rent the Land to third parties outside the Portal. Therefore, the Provider may only rent out Lands using the Portal. The obligation under this article lasts for the entire duration of the User Account Agreement.
2.3.2.If the Provider concludes a rental agreement or other similar agreement in relation to the Land outside the Portal, or if they offer to conclude such an agreement outside the Portal, this constitutes a material breach of the Provider's obligations. In such case, the Operator may, in accordance with Article 4.5 of the Terms and Conditions, block the Provider's User Account, i.e. prevent the use of the User Account (and the services provided by the Portal).
2.3.3.As part of the Land offer on the Portal, the Land is marked with the "exclusive cooperation (A)" flag.
2.3.4.Lands in Mode A are displayed at the top of the listing in the offer on the Portal (i.e. always before Lands in Modes B and C).
2.3.5.Lands in Mode A may also be subject to special preferential conditions determined by the Operator.

2.4.Non-Exclusive Partnership (Mode B)

2.4.1.In this mode, the Provider is entitled to offer the Land for rent and rent the Land to third parties outside the Portal as well.
2.4.2.However, within the Land offer via the Portal, the number of persons to whom the Land can be rented is limited (maximum capacity of the Land). In the event that a relevant rental or other similar agreement is concluded outside the Portal, thus reducing the available capacity of the Land, the Provider is obliged to immediately update the information on the available capacity of the Land in the relevant period through the User Account. The Provider is fully responsible for the proper performance of all concluded Rental Agreements and other agreements whose subject is the provision of Land for temporary use (concluded both through the Portal and based on their own activity).
2.4.3.As part of the Land offer on the Portal, the Land is marked with the "non-exclusive cooperation (B)" flag.
2.4.4.Lands in Mode B are displayed in the listing in the offer on the Portal after Lands in Mode A, but before Lands in Mode C.

2.5.Non-Exclusive Partnership (Mode C)

2.5.1.In this mode, the Provider is entitled to offer the Land for rent and rent the Land to third parties outside the Portal as well.
2.5.2.Within the Land offer via the Portal, there is no limit on the number of persons to whom the Land can be rented, and the capacity of such Land is not displayed. The Provider is fully responsible for the proper performance of all concluded Rental Agreements and other agreements whose subject is the provision of Land for temporary use (concluded both through the Portal and based on their own activity). The Provider is obliged to regularly verify the status of the unused capacity of the Land; in case of filling the capacity of the Land, they undertake to immediately inform the Operator or withdraw the Land from the offer.
2.5.3.As part of the Land offer on the Portal, the Land is marked with the "non-exclusive cooperation (C)" flag.
2.5.4.Lands in Mode C are displayed at the bottom of the listing in the offer on the Portal (i.e. always after Lands in Modes A and B).
