PRODUCT TERMS FOR ACCOMMODATION SERVICES
1.ACCOMMODATION SERVICES AND THEIR OFFER
1.1.The Provider offers the Accommodation Service on the Portal by electronic means by filling in the Accommodation Service information in the relevant form within their User Account and submitting this information to the Operator by clicking the "Offer" button. Accommodation Service information includes uploading photographs of the Accommodation Service, whereby by making an offer of the Accommodation Service, the Provider expressly authorizes the Operator to use the photographs for the purposes of the services provided by them, for the entire duration of the User Account Agreement.
1.2.In the event of any change in the Accommodation Service information provided by the Provider in the Accommodation Service offer form (Article 1.1), the Provider is obliged to update the Accommodation Service information without delay. Breach of this obligation shall be deemed to be a material breach of the Provider's obligations.
1.3.The Provider is only entitled to offer Accommodation Services for payment on the Portal that are suitable to be the subject of an Accommodation Services Agreement and for which there are no obstacles to the Interested Party's use for the agreed purpose (accommodation). In this context, the Provider declares in particular that:
1.3.1.The Provider has title to the Accommodation Facilities enabling them to provide the Accommodation Service;
1.3.2.the provision of the Accommodation Service is not prevented by any legal or other regulations, nor by any contractual or other agreement with a third party or any right of a third party;
1.3.3.The Accommodation Service is suitable for accommodation and related use;
1.3.4.The Accommodation Service is suitable to be the subject of an Accommodation Services Agreement; and
1.3.5.The Provider has all public law authorizations necessary for providing Accommodation Services.
1.4.If any of the above declarations by the Provider prove to be false, this constitutes a gross breach of the Provider's obligations under the User Account Agreement.
1.5.The Provider is solely responsible for the selection of the Accommodation Service to be offered on the Portal. This does not affect the Operator's rights pursuant to Articles 1.6 and 1.7 of these Product Terms.
1.6.The Operator is not obliged to accept the Accommodation Service offer for publication on the Portal. The Operator reserves the right to make a final decision on which Accommodation Service will be published on the Portal and not to publish the Accommodation Service on the Portal, in cases specified in Article 4.5 of the Terms and Conditions.
1.7.The Operator reserves the right to remove any Accommodation Service offer from the Portal in cases specified in Article 4.5 of the Terms and Conditions.
