PRODUCT TERMS FOR VEHICLE RENTAL
1.VEHICLES AND THEIR OFFER
1.1.The Provider offers the Vehicle on the Portal by electronic means by filling in the Vehicle information in the relevant form within their User Account and submitting this information to the Operator by clicking the "Offer" button. Vehicle information includes uploading photographs of the Vehicle, whereby by making an offer of the Vehicle, the Provider expressly authorizes the Operator to use the photographs for the purposes of the services provided by them, for the entire duration of the User Account Agreement.
1.2.In the event of any change in the Land information provided by the Provider in the Vehicle offer form (Article 1.1), the Provider is obliged to update the Vehicle information without delay. Breach of this obligation shall be deemed to be a material breach of the Provider's obligations.
1.3.The Provider is only entitled to offer Vehicles for temporary use for payment on the Portal that are suitable to be the subject of a Vehicle Rental Agreement and for which there are no obstacles to the Interested Party's use for the agreed purpose (camping). In this context, the Provider declares in particular that:
1.3.1.The Vehicle is in their exclusive ownership;
1.3.2.the provision of the Vehicle for temporary use for payment is not prevented by any legal or other regulations, nor by any contractual or other agreement with a third party or any right of a third party;
1.3.3.The Vehicle is suitable for camping and related use, in particular it is suitable for operation on roads;
1.3.4.The Vehicle is suitable to be the subject of a rental agreement; and
1.3.5.The Provider has all public law authorizations necessary for renting out Vehicles.
1.4.If any of the above declarations by the Provider prove to be false, this constitutes a gross breach of the Provider's obligations under the User Account Agreement.
1.5.The Provider is solely responsible for the selection of the Vehicle to be offered on the Portal. This does not affect the Operator's rights pursuant to Articles 1.6 and 1.7 of these Product Terms.
1.6.The Operator is not obliged to accept the Vehicle offer for publication on the Portal. The Operator reserves the right to make a final decision on which Vehicle will be published on the Portal and not to publish the Vehicle on the Portal, in cases specified in Article 4.5 of the Terms and Conditions.
1.7.The Operator reserves the right to remove any Vehicle offer from the Portal in cases specified in Article 4.5 of the Terms and Conditions.
